Kullanım ve Abonelik Koşulları
Bu koşullar, Velodynex (“biz”) tarafından sunulan Evkip mobil uygulamasının ve ilgili hizmetlerin (“Hizmet”) kullanımını düzenleyen son kullanıcı lisans sözleşmesidir. Uygulamayı indirerek veya kullanarak bu koşulları kabul etmiş olursunuz.
1. Hizmet
Evkip; ebeveynlerin çocuklarına görev ve sorumluluk tanımlamasını, tamamlanan işleri onaylamasını, puan ve ödül takibi yapmasını sağlayan bir aile uygulamasıdır. Uygulamadaki öneriler ve yaşa göre kurallar genel bilgi niteliğindedir; tıbbi, psikolojik veya pedagojik danışmanlık yerine geçmez.
2. Hesap ve aile
- Bulut hesabı yalnız 18 yaşını doldurmuş ebeveyn veya yasal temsilci tarafından açılabilir. Çocuk profilleri ve çocuk cihazları, veli tarafından ve velinin sorumluluğunda oluşturulur.
- Hesap bilgilerinizin, ebeveyn PIN’inizin ve davet kodunuzun gizliliğinden siz sorumlusunuz. Davet kodu yanlış kişiyle paylaşılırsa uygulamadan yenileyin.
- Uygulamaya girdiğiniz içerik (görevler, yorumlar, fotoğraflar) size aittir. Bu içeriği yalnız Hizmeti sunmak için işleriz.
3. Ücretsiz deneme
Her yeni aile, aile kurulduğu andan itibaren 7 gün ücretsiz deneme hakkına sahiptir. Deneme için ödeme bilgisi istenmez ve deneme sonunda otomatik ücret alınmaz. Deneme hakkı aile başına bir kez kullanılır.
4. Abonelik
- Planlar: Evkip Premium aylık veya yıllık, otomatik yenilenen aboneliktir. Güncel fiyat satın alma ekranında ve mağazada gösterilir (Türkiye’de lansman fiyatları: aylık ₺129,99, yıllık ₺999,99; vergiler dâhil).
- Aile başına: Bir ebeveynin aboneliği, o ailenin bütün cihazlarını kapsar. Abonelik satın alındığı aileye bağlanır, başka bir aileye devredilemez.
- Ödeme: Satın alma Apple App Store veya Google Play üzerinden yapılır; ücret, satın almayı onayladığınızda mağaza hesabınızdan alınır. Satıcı ve ödeme aracısı ilgili mağazadır; kart bilgilerinize erişmeyiz.
- Otomatik yenileme: Abonelik, geçerli dönem bitmeden en az 24 saat önce otomatik yenileme kapatılmadıkça aynı süre ve o andaki fiyatla yenilenir; yenileme ücreti dönem bitiminden önceki 24 saat içinde alınır.
- İptal: Aboneliği App Store hesap ayarlarından (Ayarlar → Apple Kimliği → Abonelikler) veya Google Play’den (Ödemeler ve abonelikler) dilediğiniz zaman iptal edebilirsiniz. İptal, mevcut dönemin sonunda geçerli olur; dönem sonuna kadar Premium kullanılmaya devam eder.
- İade: İade talepleri, satın almanın yapıldığı mağazanın (Apple veya Google) iade kurallarına göre o mağazaya yapılır. Abonelik, onayınızla anında ifa edilmeye başlanan elektronik bir hizmet olduğundan, mevzuatın izin verdiği ölçüde cayma hakkı kapsamı dışındadır; tüketici olarak yasal haklarınız saklıdır.
- Fiyat değişikliği: Fiyatı değiştirirsek mağazanın kurallarına göre önceden bildirilir; mevcut aboneliğinizde fiyat artışı onayınız olmadan uygulanmaz (mağazanın izin verdiği durumlar hariç).
- Süre dolunca: Deneme veya abonelik sona erdiğinde verileriniz silinmez. Kayıtları görüntüleme, görevleri tamamlama ve onaylama sürer; yeni görev, ödül ve çocuk eklemek için abonelik gerekir.
5. Kabul edilebilir kullanım
Hizmeti hukuka aykırı amaçlarla, başkalarının haklarını ihlal edecek şekilde, çocuğun yararına aykırı biçimde veya sistemin güvenliğini bozmaya yönelik kullanamazsınız; uygulamayı tersine mühendislik, kopyalama veya yetkisiz erişim girişimine konu edemezsiniz.
6. Fikri mülkiyet
Uygulama, “Evkip” adı, logosu ve içeriği Velodynex’e aittir. Size, uygulamayı kişisel ve ticari olmayan aile kullanımı için, sahip olduğunuz veya kontrol ettiğiniz cihazlarda kullanmanız için devredilemez, münhasır olmayan, sınırlı bir lisans verilir.
7. Sorumluluğun sınırı
Hizmeti özenle ve kesintisiz sunmaya çalışırız; ancak bakım, ağ veya mağaza kaynaklı kesintiler olabilir. Kanunun izin verdiği ölçüde, dolaylı zararlardan sorumlu değiliz ve sorumluluğumuz son 12 ayda Hizmet için ödediğiniz tutarla sınırlıdır. Tüketici mevzuatından doğan haklarınız saklıdır.
8. Fesih
Hesabınızı uygulamada Hesabı sil ile dilediğiniz zaman kapatabilirsiniz (aboneliği ayrıca mağazadan iptal etmeyi unutmayın). Bu koşulların ağır ihlali hâlinde hesabı askıya alabilir veya kapatabiliriz.
9. Apple App Store ile ilgili ek hükümler
Uygulamayı Apple App Store’dan edindiyseniz: (a) bu sözleşme Apple ile değil, sizinle Velodynex arasındadır; uygulamadan ve içeriğinden Apple değil Velodynex sorumludur. (b) Lisans, sahip olduğunuz veya kontrol ettiğiniz Apple markalı cihazlarda, App Store Hizmet Koşulları’ndaki kullanım kurallarına uygun kullanım içindir. (c) Apple’ın uygulama için bakım veya destek yükümlülüğü yoktur. (d) Uygulamanın geçerli bir garantiye uymaması hâlinde Apple’a bildirebilirsiniz; Apple satın alma bedelini (varsa) iade edebilir, bunun dışında Apple’ın garanti yükümlülüğü yoktur. (e) Ürün sorumluluğu, mevzuata uyumsuzluk ve tüketici koruma talepleri dâhil uygulamayla ilgili talepler Apple’a değil Velodynex’e yöneltilir. (f) Uygulamanın üçüncü kişi fikri mülkiyet haklarını ihlal ettiği iddiasının incelenmesi ve çözümü Apple’ın değil Velodynex’in sorumluluğundadır. (g) Uygulamayı ABD ambargosuna tabi bir ülkede veya ABD yasaklı kişi listelerinde yer alarak kullanmadığınızı beyan edersiniz. (h) Apple ve bağlı şirketleri bu sözleşmenin lehtar üçüncü tarafıdır ve kabulünüzle bu sözleşmeyi size karşı uygulama hakkına sahip olur.
10. Değişiklikler
Bu koşulları güncelleyebiliriz; önemli değişiklikleri uygulama içinde ve bu sayfada duyururuz. Değişiklikten sonra kullanmaya devam etmeniz güncel koşulları kabul ettiğiniz anlamına gelir.
11. Uygulanacak hukuk ve iletişim
Bu koşullara Türk hukuku uygulanır. Tüketiciler, yasal sınırlar içinde tüketici hakem heyetlerine ve tüketici mahkemelerine başvurabilir; diğer uyuşmazlıklarda Ankara mahkemeleri ve icra daireleri yetkilidir. Terms of Use and Subscription
These terms are the end-user licence agreement governing the Evkip mobile app and related services (the “Service”) provided by Velodynex (“we”). By downloading or using the app you accept them. In case of any discrepancy, the Turkish version prevails.
1. The Service
Evkip is a family app that lets parents define tasks and responsibilities for their children, approve completed work and track points and rewards. Suggestions and age-based rules in the app are general information and are not medical, psychological or educational advice.
2. Account and family
- A cloud account may only be opened by a parent or legal guardian aged 18 or over. Child profiles and child devices are created by, and under the responsibility of, the parent.
- You are responsible for keeping your account, parent PIN and invite code confidential. If the invite code is shared with the wrong person, rotate it in the app.
- Content you enter (tasks, comments, photos) belongs to you. We process it only to provide the Service.
3. Free trial
Each new family gets a 7-day free trial starting when the family is created. No payment details are required and nothing is charged automatically at the end of the trial. The trial can be used once per family.
4. Subscription
- Plans: Evkip Premium is an auto-renewing monthly or yearly subscription. The current price is shown on the purchase screen and in the store (launch prices in Türkiye: ₺129.99 per month, ₺999.99 per year, taxes included).
- Per family: one parent’s subscription covers all devices of that family. The subscription is linked to the family it was bought for and cannot be transferred to another family.
- Payment: purchases are made through the Apple App Store or Google Play and charged to your store account at confirmation of purchase. The store is the seller and payment intermediary; we never see your card details.
- Auto-renewal: the subscription renews for the same period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period; renewal is charged within 24 hours before the period ends.
- Cancellation: cancel any time in your App Store account settings (Settings → Apple ID → Subscriptions) or in Google Play (Payments & subscriptions). Cancellation takes effect at the end of the current period; Premium stays active until then.
- Refunds: refund requests are handled by the store where you purchased (Apple or Google) under its refund rules. As an electronic service that starts immediately with your consent, the subscription is outside the right of withdrawal to the extent permitted by law; your statutory consumer rights are unaffected.
- Price changes: if we change prices you will be notified in advance under the store’s rules; a price increase is not applied to your existing subscription without your consent except where the store allows it.
- When access ends: when the trial or subscription ends, your data is not deleted. Viewing records and completing and approving tasks continue; adding new tasks, rewards and children requires a subscription.
5. Acceptable use
You may not use the Service unlawfully, in a way that infringes others’ rights or is against a child’s best interests, or to compromise the system’s security; you may not reverse-engineer, copy or attempt unauthorised access to the app.
6. Intellectual property
The app, the “Evkip” name, logo and content belong to Velodynex. You are granted a non-transferable, non-exclusive, limited licence to use the app for personal, non-commercial family use on devices you own or control.
7. Limitation of liability
We aim to provide the Service with care and without interruption, but maintenance, network or store issues may cause outages. To the extent permitted by law, we are not liable for indirect damages, and our liability is limited to the amount you paid for the Service in the last 12 months. Your statutory consumer rights are unaffected.
8. Termination
You may close your account at any time with Delete account in the app (remember to cancel the subscription in the store as well). We may suspend or close an account for serious breach of these terms.
9. Additional terms for the Apple App Store
If you obtained the app from the Apple App Store: (a) this agreement is between you and Velodynex, not Apple; Velodynex, not Apple, is responsible for the app and its content. (b) The licence is for use on Apple-branded products you own or control, as permitted by the Usage Rules in the App Store Terms of Service. (c) Apple has no obligation to provide maintenance or support for the app. (d) If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); Apple has no other warranty obligation. (e) Velodynex, not Apple, is responsible for addressing any claims relating to the app, including product liability, legal or regulatory non-compliance and consumer protection claims. (f) Velodynex, not Apple, is responsible for the investigation, defence, settlement and discharge of any third-party intellectual property infringement claim. (g) You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties. (h) Apple and its subsidiaries are third-party beneficiaries of this agreement and, upon your acceptance, Apple will have the right to enforce it against you.
10. Changes
We may update these terms and will announce material changes in the app and on this page. Continuing to use the app after a change means you accept the updated terms.
11. Governing law and contact
These terms are governed by Turkish law. Consumers may apply to consumer arbitration committees and consumer courts within statutory limits; for other disputes the courts and enforcement offices of Ankara have jurisdiction.
